This document displays a background paper for the UNDP conference on Restructuring and Federalism in Nepal that took place in Kathmandu 23-24 March 2007. The paper has been authored by Yash Ghai and in it Ghai deals with the governing structure of Nepal and how this affects the possibilities for the population to participate in public affairs.

The paper is an expanded version of a chapter written for Intrnational IDEA and forthcoming in its publication on constitution making in Nepal.
